General Terms and Conditions (GTC)
These GTC apply to all services offered by AZ CamArt, represented by Alain Zlatkov and Lisa Högger. By commissioning our services, you accept these terms. Deviating terms will only be recognized if agreed upon in writing.
1. Scope
These GTC apply to all contracts between AZ CamArt and the client regarding services in photography, videography, social media management, and related activities.
2. Conclusion of Contract
The contract is concluded upon written confirmation of the offer or acceptance of an order by AZ CamArt. Offers and prices listed on the website or in other promotional materials are non-binding and may be changed at any time.
3. Services
AZ CamArt provides the services described in the contract or offer with due diligence. Changes to the scope of services are only possible by written agreement. The exact scope of services is determined by the individual agreement with the client.
4. Prices and Payment Terms
All prices are quoted in Swiss Francs (CHF) and are exclusive of VAT unless otherwise stated. The client is obligated to pay the agreed prices. Payment terms are set forth in the contract. Payments are generally due within 10 days of contract conclusion, unless otherwise agreed. Monthly installments are also possible, with payment due on the 1st of each month. AZ CamArt reserves the right to request advance payments.
5. Cancellations and Changes
Cancellations by the client must be made in writing. If a service is canceled less than 48 hours before the scheduled appointment, we reserve the right to charge a cancellation fee of up to 50% of the agreed price. Changes to appointments or services can only be made by mutual agreement and written confirmation from AZ CamArt. By default, unless otherwise agreed, the minimum term of a social media management package (Signature Package, Premium Package, or Elite Package) is six months. After six months, the contract can be terminated at the end of any month.
6. Usage Rights, Artistic Freedom, and Decision-Making Authority
All works created under the contract by AZ CamArt (photos, videos, graphics, texts, and other creative content) are protected by copyright and remain the property of AZ CamArt. The client is granted a simple, non-transferable usage right for the agreed purpose.
AZ CamArt retains artistic freedom in the execution of commissioned services. The style, visual design, and all creative decisions rest with AZ CamArt, particularly where no explicit specifications are provided by the client. The client acknowledges that subjective opinions such as "I don’t like it" or "I imagined it differently" do not entitle them to changes or revisions.
The client may provide feedback or request changes once. Additional changes or revisions will only be considered if explicitly agreed upon in writing by AZ CamArt. Once AZ CamArt deems the work completed and aligned with the agreed style, it is considered final and binding.
7. Liability and Warranty
AZ CamArt commits to performing the commissioned services with the utmost care. AZ CamArt is liable for defects caused by gross negligence or intent within the legal framework. No liability is accepted for damages resulting from force majeure, technical issues, or other unforeseeable events. The client is obligated to report any defects immediately to allow for rectification.
8. Confidentiality and Data Protection
AZ CamArt treats all data and information obtained during contract execution confidentially. The handling of personal data is carried out in accordance with our [Privacy Policy] and applicable data protection regulations.
9. Default and Non-Performance
If the client fails to meet their payment obligations or refuses to accept the agreed services, AZ CamArt is entitled to terminate the contract without notice and claim damages.
10. Jurisdiction and Applicable Law
The place of jurisdiction for all disputes arising from contracts with AZ CamArt is the location of the company's registered office. Swiss law applies, excluding the UN Sales Convention (CISG).
11. Final Provisions
Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall not be affected. Changes and additions to these GTC must be made in writing.
